1.1. Introduction and acceptance
These Terms and Conditions ("Terms") govern your access to and use of Unforget, including our mobile applications, websites, social features, content tools, messaging functions, AI chat, recommendation systems, and any related products or services that link to these Terms (together, the "Service").
By creating an account, accessing, browsing, posting content, using the AI chat, or otherwise using the Service, you agree to these Terms. If you do not agree, you must not use the Service.
These Terms form a legally binding agreement between you and Unforget. If you use the Service on behalf of a company, organisation or other legal entity, you confirm that you have authority to bind that entity.
1.2. Other policies that form part of these Terms
The following documents are incorporated into these Terms and apply to your use of Unforget:
- Privacy Policy;
- AI Terms and Transparency Notice;
- Community Guidelines;
- Cookie and Similar Technologies Policy;
- any additional product, creator, business, advertising, paid-features, beta, developer or competition terms that we make available for specific features.
1.3. What Unforget is
Unforget is a social media and personal-expression platform designed to help users capture, share, discuss and rediscover moments, thoughts, memories, posts and conversations. Depending on the version of the Service available in your country, Unforget may allow users to create a profile, publish posts, upload photos or videos, follow or connect with others, send messages, receive recommendations, use AI chat and ai data analyze features, and interact with content created by other users.
Unforget may change over time. We may add, remove, test or modify features, including beta features, where this is reasonable and lawful.
1.4. Eligibility and age
You must be at least 15 years old to create an Unforget account, unless we expressly state a different minimum age for your country and have implemented the required age-assurance and parental-consent measures. Some features may require you to be 18 or older, including paid features, creator monetisation, business tools, live features, or certain AI functions.
If you are under 18, you confirm that your parent or legal guardian has reviewed these Terms with you and agrees to your use of the Service. We may request age verification or parental authorisationwhere required by law or where necessary to protect users.
You must not use the Service if you are prohibited from receiving it under applicable law, if we have previously terminated your account for serious or repeated violations, or if you are subject to sanctions or restrictions that make providing the Service unlawful.
1.5. Account registration and security
When you create or use an account, you agree that:
- the information you provide must be accurate, complete and kept up to date;
- you are responsible for safeguarding your login credentials and devices;
- you must not share, sell, rent, transfer or permit others to use your account;
- you must notify us immediately if you believe your account has been accessed without authorisation;
- we may suspend or restrict accounts where we reasonably suspect fraud, impersonation, underage use, security compromise, legal risk or breach of these Terms.
1.6. Your right to use the Service
Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable licence to access and use the Service for lawful personal purposes, and, where applicable, lawful business or creator purposes enabled by Unforget.
You must use only the interfaces and functionality we provide or expressly authorise. You must not copy, modify, reverse engineer, scrape, extract, interfere with, overload, circumvent, jailbreak, prompt-inject, bypass safety systems, or attempt to gain unauthorised access to any part of the Service, except to the extent that applicable law expressly permits.
1.7. User content
"User Content" means any content you create, upload, post, publish, send, display, store, import, generate, transmit or otherwise make available through the Service, including text, usernames, profile information, photos, videos, audio, comments, messages, reactions, captions, hashtags, AI prompts, AI outputs when saved or shared, and metadata associated with such content.
You are responsible for your User Content and for ensuring that you have all rights, permissions and lawful bases needed to create, upload, share or otherwise use it. You must not post or share content that infringes another person's intellectual property, privacy, data protection, publicity, image, confidentiality, contractual or other rights.
1.8. Ownership of User Content and licence to Unforget
You retain ownership of your User Content. Nothing in these Terms transfers ownership of your content to Unforget.
To operate, protect, improve and provide the Service, you grant Unforget a worldwide, non-exclusive, royalty-free, transferable and sublicensable licence to host, store, reproduce, process, adapt, format, translate, transcode, display, perform, distribute, communicate to the public, make available, promote and otherwise use your User Content in connection with the Service.
1.9. User licence to other users
When you make User Content visible to other users or the public, you grant those users a non-exclusive licence to access, view and interact with that content through the Service, and to share or reuse it only as enabled by Unforget features and your settings.
Other users must not copy, download, extract, exploit, commercialise or use your content outside the Service unless you have given permission or the law allows it.
Unforget does not have any responsibility for the above and any claims shall be made only between the users.
1.10. Public content, private content and settings
Some Unforget features may be public by default and others may be private or limited to selected audiences. You are responsible for checking your settings before posting or sharing content.
Even where content is private, other users may screenshot, record, copy or share it outside the Service without our permission. We cannot guarantee that content shared with others will remain confidential.
Direct messages are intended for communication between selected users. They are not public posts. However, we may process messages and related metadata as explained in the Privacy Policy, including for delivery, safety, security, reporting, legal compliance and support.
1.11. Community rules and prohibited conduct
You must comply with our Community Guidelines. In particular, you must not use the Service to:
- do anything illegal or facilitate illegal activity;
- harass, bully, threaten, intimidate, exploit or abuse others;
- promote hatred, discrimination or violence against protected groups;
- post sexual exploitation, child sexual abuse material, grooming, non-consensual intimate content or sexualised content involving minors;
- impersonate another person, misrepresent your identity or create deceptive accounts;
- spread scams, spam, malware, phishing, platform manipulation, fake engagement or coordinated inauthentic behaviour;
- share private personal data without permission, including addresses, ID documents, phone numbers, private messages or intimate images;
- infringe intellectual property or confidential information;
- use AI features to generate or distribute illegal, deceptive, harmful, exploitative, abusive, manipulative or infringing content;
- circumvent moderation, reporting, safety, age-gating, access controls, rate limits or technical restrictions.
1.12. AI features
Unforget may provide AI chat, AI assistance, AI-generated suggestions, summaries, search, recommendations, moderation assistance or other AI-enabled features ("AI Features"). AI Features are governed by these Terms, the AI Terms and Transparency Notice, the Privacy Policy and any feature-specific notices.
AI outputs may be inaccurate, incomplete, outdated, biased or unsuitable. You must independently verify important information. AI Features are not a substitute for professional legal, medical, psychological, financial, safety, emergency or other expert advice.
You remain responsible for prompts you submit and outputs you choose to use, save, publish or share.
1.13. Recommender systems and personalisation
Unforget may use recommender systems to rank, suggest, prioritise, demote or personalise content, accounts, topics, memories, notifications, search results or ads.
The main parameters may include your interactions, follows, cercle, connections, likes, comments, shares, saves, searches, language, location at country or city level where used, device signals, content type, content recency, popularity, reported content, safety signals, user settings and feedback such as "not interested".
1.14. Content moderation and enforcement
We may review, restrict, label, age-limit, reduce visibility, remove, disable access to, demonetise or refuse to recommend content, and we may warn, restrict, suspend, terminate or ban accounts where we reasonably believe that content or behaviour is illegal, violates these Terms or our policies, creates safety or security risk, infringes rights, or may expose Unforget, users or others to harm or legal liability.
Moderation may be based on user reports, trusted notifier reports where applicable, legal notices, automated tools, AI-assisted systems, human review, proactive investigations or regulatory requirements.
Where required by law, we will provide affected users with a clear and specific statement of reasons for certain moderation decisions and information about available appeal or redress options.
1.15. Notice-and-action for illegal content
Any person or entity may notify us of specific content they believe is illegal through a related in app feature, or other provided channels. Notices should include enough information for us to identify the content, understand the alleged illegality, contact the notifier, and process the notice diligently.
We may reject notices that are manifestly unfounded, abusive, duplicative or insufficiently substantiated. We may suspend processing privileges or take other lawful action against users or notifiers who repeatedly submit manifestly illegal content, manifestly unfounded notices or manifestly unfounded complaints.
1.16. Appeals and complaint handling
Where we remove or restrict your content, account or monetisation, or decide not to act on a notice you submitted, you may be able to appeal within a concrete stated time from the decision through a specific feature in the app, unless the decision is not appealable under applicable law or because of severe abuse, legal restriction, safety risk or account deletion.
Appeals must be sufficiently precise and substantiated. We will review appeals in a timely, diligent, non-discriminatory and non-arbitrary manner. Where required by law, appeal decisions will be taken under the supervision of appropriately qualified staff and not solely by automated means.
EU users may also have access to certified out-of-court dispute settlement bodies and courts, where applicable.
1.17. Advertising, branded content and commercial communications
Unforget may display advertising or sponsored content. Where required, we will provide information about the advertiser and the main parameters used to determine why an ad was shown to you.
We do not permit advertising based on profiling using special-category personal data. Where we know with reasonable certainty that a user is a minor, we will not present ads based on profiling using that user's personal data.
1.18. Intellectual property rights of Unforget
The Service, software, code, interface, design, databases, algorithms, trade marks, logos, trade names, branding, documentation, and all other materials provided by Unforget are owned by Unforget or its licensors and are protected by intellectual property and other laws.
You may not use the Unforget name, logo, branding or trade marks without our prior written permission, except as allowed by law.
1.19. Copyright and intellectual property complaints
If you believe content on Unforget infringes your intellectual property rights, you may submit a complaint through "[email protected]". Your notice should identify the protected work, the allegedly infringing content, your contact details, and a statement that the information is accurate and that you are the right holder or authorised to act for the right holder.
We may remove or restrict allegedly infringing content and may terminate repeat infringers in appropriate circumstances. Users may submit a counter-notice or appeal where available.
1.20. Paid features, subscriptions and refunds
Some features may be free and others may require payment, subscription or in-app purchase. Prices, billing periods, renewal terms, cancellation methods and any trial terms will be shown before purchase.
Purchases made through Apple App Store, Google Play or another third-party platform may be subject to that platform's payment and refund terms. Nothing in these Terms limits mandatory consumer rights that apply in your country.
1.21. Third-party services
The Service may use or link to third-party services, including cloud hosting, analytics, payment providers, app stores, AI providers, login services, maps, content delivery networks, moderation providers and external websites.
Third-party services may be subject to their own terms and privacy policies. We are not responsible for third-party services except where applicable law provides otherwise.
1.22. Legal requests and safety disclosures
We may access, preserve, restrict, remove or disclose information where we reasonably believe this is necessary to comply with law, legal process, regulatory requests, orders from competent authorities, enforcement of these Terms, security, fraud prevention, protection of rights, or prevention of harm to users or the public.
We will assess legal requests according to applicable law and our internal procedures.
1.23. Service availability and changes
We aim to provide a reliable and secure Service, but we do not guarantee that it will always be available, uninterrupted, error-free, secure, compatible with every device or free of harmful content.
We may suspend, withdraw, modify or restrict all or part of the Service for maintenance, security, legal, operational or business reasons.
1.24. Termination by you
You may stop using the Service at any time. You may delete or deactivate your account using the in app procedure. The Privacy Policy explains how deletion affects personal data and retention.
Certain clauses survive termination, including content licences to the extent described above, intellectual property, disclaimers, liability limits, dispute clauses and any obligations that by nature should continue.
1.25. Termination or suspension by Unforget
We may suspend, restrict or terminate your account or access to the Service if we reasonably believe that:
- (a) you breached these Terms or our policies;
- (b) your account creates security, safety, legal or reputational risk;
- (c) your account is fraudulent, inactive, automated, impersonating or unauthorised;
- (d) we are required to do so by law or a competent authority; or
- (e) our provision of the Service to you is no longer technically, legally or commercially viable.
Where required and appropriate, we will notify you and provide reasons and appeal options. We may withhold notice where legally prohibited or where notice would create risk, enable abuse, compromise safety or security, or prejudice an investigation.
1.26. Disclaimers
The Service is provided on an "as is" and "as available" basis to the extent permitted by law. User Content is created by users and not by Unforget. We do not guarantee that User Content, AI outputs, recommendations, search results or communications are accurate, complete, lawful, safe, non-offensive, reliable or suitable for your purposes.
Nothing in these Terms excludes or limits rights that cannot be excluded or limited under applicable consumer, data protection or other mandatory law.
1.27. Limitation of liability
To the maximum extent permitted by applicable law, Unforget will not be liable for indirect, incidental, special, consequential, punitive or exemplary damages; loss of profits, revenue, business, data, goodwill or reputation; or damages arising from User Content, AI outputs, third-party services, unauthorised access, service interruptions or your misuse of the Service.
Where liability cannot be excluded, our liability will be limited to the maximum extent permitted by applicable law. For consumers, this clause does not affect mandatory rights or remedies available in your country of residence.
1.28. Indemnity for business users
If you use the Service for business, professional, creator, commercial or organisational purposes, you agree to indemnify and hold Unforget harmless from claims, damages, losses, liabilities, costs and expenses arising from your content, your use of the Service, your breach of these Terms, your infringement of rights, or your violation of law.
This clause does not apply to consumers where prohibited by law.
1.29. Governing law and disputes
These Terms are governed by the laws of the Republic of Cyprus, without prejudice to mandatory consumer protection rights that may apply in your country of residence.
The courts of Cyprus shall have jurisdiction, unless another forum is required by mandatory law.
1.30. Changes to these Terms
We may update these Terms from time to time. Where changes are material, we will provide reasonable notice, such as through the app, email, website notice or account notification, unless immediate changes are needed for legal, security or operational reasons.
If you continue using the Service after updated Terms take effect, you accept the updated Terms. If you do not agree, you must stop using the Service and may delete your account.
